1. Parties

Elizabeth Kate Albanis ("EKA"), ABN 92 687 074 147, of Canberra, ACT 2913.
The party described as the "Participant"..

2. Introduction

EKA conducts a business trading as Liz Albanis Wellness.
The Participant has chosen to undertake the Program.
EKA agrees to provide yoga classes, nutrition/fitness/health coaching services, and the Participant agrees to accept these services under the terms of this agreement.

3. Definitions

"Program" means the program described in the checkout.

4. Interpretation

Unless the context requires otherwise:

The Introduction is correct.
Headings do not affect interpretation.
Singular includes plural and vice versa.
A reference to one gender includes all genders.
"Person" includes any legal entity.
"Party" includes successors and permitted assigns.
References to parts include the whole.
Provisions must not be construed against a drafting party.
Provisions must be read down if invalid, or severed if necessary.
Definitions apply to other grammatical forms.

Exceptional Circumstances: Unexpected events preventing the Participant from attending sessions.

5. Program: Fees & Access

5.1 3R Program: Coaching is provided via audio/visual content . Program Fees are outlined in the checkout.. A one-time non-refundable setup fee of $30 AUD applies.
Yoga Designed for You - Private Sessions Program' fees and access are outlined in checkout.
Yoga Teacher Mentoring - Private Sessions Program' fees and access are outlined in checkout.

5.2 Term: Begins upon acceptance and payment. Access starts immediately for 3R Program.

5.3 Auto-Renewal: If the product is a subscription, it renews monthly unless cancelled.

5.4 No Refunds: Due to digital nature, all sales are final.

5.5 3R Program Cancellation: Cancel anytime via account settings. Access continues until the billing period ends.

5.6 3R Monthly Membership: Monthly charges commence 30 days after the initial purchase.

5.7 3R Membership Access: Access to content is granted as long as the subscription o remains active or payment has been honoured (for non subscription products).

5.8 Amounts Owing: Failed payments result in suspended access until resolved.

5.9 Responsibility: The Participant accepts full responsibility for their own success.

6. No Warranties

6.1 Success Not Guaranteed: No specific results are promised. Success depends on individual effort.

7. Confidentiality & Intellectual Property

7.1 Confidentiality: Only authorised users may access the Program. Sharing of content or credentials is prohibited.

7.2 Intellectual Property: All content belongs to EKA and/or its licensors. No ownership or rights are transferred to the Participant. Use of trademarks is prohibited.

8. Miscellaneous

8.1 Non-Transferability: Rights under this agreement are personal and non-transferable.

8.2 Indemnification: The Participant agrees to defend and hold harmless EKA from any liabilities or damages arising from program participation.

9. Governing Law

9.1 Jurisdiction: Governed by the laws of the Australian Capital Territory (ACT).

9.2 Disputes: Parties submit to the exclusive jurisdiction of ACT courts.

9.3 Venue: No objections to ACT courts as an inconvenient forum.

10. Health & Safety Disclaimer

You must disclose any known or newly diagnosed conditions, including pregnancy. Always consult a healthcare provider before starting or changing your exercise or lifestyle routine. This course does not provide medical advice. Adjust practices to your own level and stop if discomfort occurs.

Participation is at your own risk. You accept responsibility for monitoring your condition and using the platform within your limits. The creators are not liable for any injuries.
